3. User Accounts

Registration

You must:

• Be at least 18 years old
• Provide accurate and complete information
• Keep your password secure
• Notify us of unauthorized access

Account Responsibility

You are responsible for:

• All activity under your account
• Maintaining account security
• Keeping your contact information current

4. Subscription Plans

Free Trial

• 7-day free trial with full access
• No credit card required
• Limited calculations after trial ends

Paid Plans

• Pro Plan: £15/month - Unlimited calculations and features
• Business Plan: £30/month - Team features and priority support

Billing

• Monthly subscriptions auto-renew
• Charged to your payment method on file
• Cancel anytime (no refunds for partial months)
• Price changes with 30 days notice

5. Payment Terms

Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method:

• Immediately upon subscription
• Automatically on each renewal date
• For any additional services purchased

Refund Policy

We offer refunds only in the following cases:

• Service unavailability for more than 48 consecutive hours
• Billing errors (we'll correct and refund)
• First-time subscribers within 14 days (one-time courtesy)

No refunds for:

• Partial month usage
• Forgotten cancellations
• User error or dissatisfaction

6. Acceptable Use

You May:

• Use the Service for lawful construction estimation
• Create and save unlimited projects (Pro/Business)
• Export your data
• Share results with clients (with attribution)

You May NOT:

• Share your account credentials
• Reverse engineer or copy the Service
• Use automated tools to access the Service
• Resell or redistribute the Service
• Use for illegal or fraudulent purposes
• Overload or interfere with the Service
• Remove attribution or branding

7. Intellectual Property

Our Rights

TakeOffPro owns all rights to:

• The Service software and code
• TakeOffPro branding and trademarks
• Calculator algorithms and formulas
• Design and user interface

Your Content

You retain ownership of:

• Your project data and calculations
• Exported PDFs and BOQs

By using the Service, you grant us a license to store, process, and display your content solely to provide the Service.

8. Disclaimer of Warranties

We do not guarantee:

• Accuracy: Calculations are tools, not professional advice
• Availability: Service may be interrupted for maintenance
• Suitability: Results may not meet your specific needs
• Completeness: All features or data at all times

9. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the last 12 months
• We are not responsible for third-party services (Firebase, Stripe, etc.)

This includes liability for:

• Calculation errors or inaccuracies
• Data loss or corruption
• Service interruptions
• Financial losses from using our calculations
• Project delays or failures

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains:

• What data we collect
• How we use and protect it
• Your rights regarding your data

11. Cancellation and Termination

You May Cancel:

• Anytime from your account settings
• Access continues until end of billing period
• No refund for remaining time

We May Terminate if You:

• Violate these Terms
• Engage in fraudulent activity
• Fail to pay subscription fees
• Misuse the Service

Upon Termination:

• Access to the Service ends immediately
• Your data is retained for 30 days
• Export your data before account closure

12. Changes to Service

We reserve the right to:

• Modify or discontinue features
• Change pricing (with 30 days notice)
• Update calculators and formulas
• Improve the Service

13. Changes to Terms

We may update these Terms:

• Notice via email or in-app notification
• Effective 30 days after notice
• Continued use means acceptance
• Cancel if you disagree with changes

14. Governing Law

These Terms are governed by the laws of England and Wales. Disputes will be resolved in UK courts.

15. Indemnification

You agree to indemnify and hold harmless TakeOffPro from claims arising from:

• Your use of the Service
• Violation of these Terms
• Infringement of third-party rights
• Your projects and calculations

16. Severability

If any provision of these Terms is found invalid, the remaining provisions continue in full effect.
